A collision between two (2) vehicles was reported to have occurred in Perak, Malaysia. Driver A, who was driving a black Toyota Land Cruiser Prado from Ayer Tawar to Taiping and while travelling along the Northbound route, saw an unknown animal, so he tried to avoid the animal but the Toyota Prado encroached into the opposite lane and hit the oncoming BMW, before the Toyota Prado swerved to the left hit the guardrail at the left side of the road.
Damage Analysis & Interpretation:
We found no evidence of collision between the Toyota Prado and the BMW, based on the following:
- Microscopic views of the white residue on the nearside and offside of the Toyota Prado indicate a collision with a concrete object and not the BMW or any other road objects at the scene (e.g. guardrail & electric poles).
Microscopic views of the white residue on the nearside doors and fenders of the Prado.
Microscopic views of the white residue on the offside front fender of the Prado.
- The scratches on the offside front fender (90-120cm) and nearside (maximum 120cm) of the Toyota Prado are higher than the offside front fender and bonnet of the BMW (80-95cm).
- No black paint transfer, which originated from the BMW, observed on the Toyota Prado.
- The location in the scene photographs (white line at side of the road) is inconsistent with the actual scene shown (no white lines at both sides of the road).
Expected Position
Actual Position
Comparison of final resting position of the Prado – nearside turn
Expected Collision Point
Actual Damage – Prado
Actual Damage – BMW
Expected frontal damage versus actual frontal damage
Based on the positions in order to match the actual damage on both vehicles, our simulation suggested that both vehicles would not swerve to their left and hit the guardrails beside the roads, but would only rotate clockwise after the collision.
Positions of the Prado and the BMW during the collision – to match the actual frontal damage
Sequential movements of the Prado and the BMW – to match the actual frontal damage
Therefore, we have concluded that the damage on both the vehicles is inconsistent with the incident
circumstances alleged by both drivers.
